3. COR (Chain of Responsibility) Penalties, infringements and non-compliance:
Heavy Vehicle National Law – 2015 Court Imposed and Infringement Penalties (PDF, 988 KB) provides a summary of the penalties and infringements outlined in the Heavy Vehicle National Law (HVNL).
If you consign, pack, load or receive goods as part of your business, you could be held legally liable for breaches of the Heavy Vehicle National Law (HVNL) even though you have no direct role in driving or operating a heavy vehicle. In addition, corporate entities, directors, partners and managers are accountable for the actions of people under their control. This is the ‘chain of responsibility’ (COR).
The aim of COR is to make sure everyone in the supply chain shares equal responsibility for ensuring breaches of the HVNL do not occur. Under COR laws if you exercise (or have the capability of exercising) control or influence over any transport task, you are part of the supply chain and therefore have a responsibility to ensure the HVNL is complied with.
The law recognises that multiple parties may be responsible for offences committed by the drivers and operators of heavy vehicles. A person may be a party in the supply chain in more than one way. For example they may have duties as the employer, the operator and the consigner of goods.
Legal liability applies to all parties for their actions or inactions.
If pulled over in transit, for example; without a permit, incorrect equipment for the mass of the load (overweight) for the particular trailer or trailer combination that is being used, or under estimating the weight of the load are extremely severe.
Penalties in excess of $10,000.00 are applicable in these instances in Queensland alone.
4. Insurances
The heavy haulage business involves shifting oversize or overmass equipment that happens to be worth a lot of money so insurance is extremely important.

SMC Heavy Haulage also maintains additional insurances and together you’re covered for damage, loss, accident, fire, theft or overturning of the vehicle while in transit.
Our insurance costs are always included in our total quoted price to move your equipment. Always ensure your service provider holds the correct insurances. Use your due diligence to confirm insurances are current and in place. If you and your current heavy haulage supplier do not hold the correct insurances, you will be responsible for costs associated with damage, loss, accident, fire, theft or overturning of the vehicle while in transit.

5. Statutory Class 1 OSOM (Oversize/Overmass) Permits
Heavy Haulage prime movers and trailers are considered OSOM (Oversize Overmass) OSOM vehicles are defined as Class 1 vehicles under the Heavy Vehicle National Law. A vehicle or vehicle combination is considered to be OSOM if it exceeds any general access mass or dimension limits. Which Heavy Haulage and Heavy Haulage equipment most certainly fall into.
Typical examples include:
- Agricultural machines such as harvesters and grain augers
- Vehicle combinations, including low loaders, steerable platform trailers, carrying large indivisible items such as mining and construction vehicles, bridge components or building infrastructure
- Special purpose vehicles such as mobile cranes, concrete pump trucks and drilling rigs
SMC Heavy Haulage will apply for the specific Class 1 Oversize Overmass (OSOM) permit/s approval/s required to legally undertake your job, this cost is also, always included in our total quoted price to move your equipment.
6. Pilot and Escort Vehicles
Pilot and escort vehicles play important road safety roles in the movement of OSOM vehicles on all national roads. The purpose of a pilot vehicle is to warn other road users of the presence of an OSOM vehicle/combination. They are a condition of permit and required by law for the safe movement of OSOM vehicles.
An escort vehicle means a pilot vehicle that is driven by a police officer or another person authorised to direct traffic under an Australian road law.
State-wide Oversize Travel Curfews are imposed each year during various public holiday periods across most states of Australia for vehicles with oversize loads, oversize plant vehicles (cranes, drill rigs, loaders etc) and agricultural vehicles (tractors, combines)

Our fleet only consists of Cab Over Prime Movers, this keeps our equipment combination length down. This cuts the additional cost associated with having a 2nd pilot vehicle due to length as a condition of permit in most medium sized moves, this factor alone is a highly significant cost saving for our customers.
Our quote includes all necessary pilots and standard permit fees, but does not include supervision by the governing road authorities. Council, Supervision and Police Escorts are usually deemed at the discretion of the council and road authority at time of permit approval, if these are a condition of permit and required by law, they will be charged to your account on a ‘user pays’ system.
